Our conditions for serving a mare
All owners of mares who avail of the stallions from the stud farm Gut Flehinghaus for the purpose of serving the mare acknowledge the conditions for serving a mare that are subsequently detailed and that will be made known to the owner of the mare or their representative prior to the first insemination. The stallions can be inspected after a notification via telephone.
Matters of hygiene in connection with serving a mare
Only mares that have undergone a swap test carried out by a veterinarian are eligible for an insemination. This test must not date back more than three weeks when the mare is to be served and will expire after the second futile insemination.
Conditions for stabling horses
Mares must not have horseshoes on their hind feet. The owner of the stallion is entitled to have a veterinarian treat the mare or the foal in the case of an illness or an injury. The owner of the mare is liable for the costs that arise from these treatments. Mares that are stabled with the stud farm and that are to be naturally inseminated must be inoculated against viruses and influenza, which must be evidenced by valid documents.
Costs for stabling mares
The fees for stabling mares without foals amount to €10 and to €12 for mares with trained foals. Delivering and collecting mares is only possible after a notification. The fees for stabling mares have to be fully paid by the time the mare is collected.
General business conditions
The fees for serving mares which are brought to the stud farm for an ambulatory (i.e. daily) insemination are to be paid prior to the first insemination. The fees for serving mares which are to remain in the stud farm are to be paid when the mare is collected. This also applies to the fees for stabling mares.
By paying the fees for serving the mare you are entitled to avail of the stallion within the period allocated to serving mares, which is from 1st February to 31st of July of each year. A breeding certificate will be issued to certify the insemination. The breeding certificate will only be submitted if the fees for serving the mare are fully paid. Pursuant to the articles on breeding, the breeding association is authorized to issue documents verifying the animal’s pedigree or birth certificates only for those foals for which a proper breeding certificate including documents certifying its birth and other relevant details can be presented. In order to issue the breeding certificate, documents verifying the mare’s pedigree must be presented. A copy of these documents is sufficient. In the case of a second insemination, the breeding certificate has to be presented so that the dates of the second insemination can be entered.
Costs arising from examinations such as follicle checks, hormone injections, pregnancy tests and ultrasound examinations are to be covered by the owner of the mare.
Aids such as ropes that ensure the stallion’s safety are explicitly allowed.
In general, fees for serving a mare are non-refundable. This also applies if the mare fails to get pregnant or if in the case of a pregnancy resulting from the insemination the mare dies prior to the foal’s birth, has an accident or is in any other way rendered unfit for breeding.
Liability
The owner of the stabled mare declares that the risks the owner or anyone in charge of the animal is exposed to are fully covered by a third party liability insurance. The owner is obliged to exempt the stud farm from any claims for damages third parties might make.
The stud farm Gut Flehinghaus is not liable for any damages the mare or the foal might suffer. This does not apply to intention or gross negligence. Furthermore, the stud farm is not liable for damages or injuries caused to the owner of the mare or their representative. This also applies to any diseases the stallion might have transmitted to the mare and the diseases’ implications as well as to injuries resulting from serving the mare. In particular, any liability for compensations payable to people employed with the stud farm for the purpose of serving or stabling the mare is denied.
Acceptance of the stud farm’s conditions and the place of performance
The conditions for serving a mare are considered accepted with the act of stabling the mare or introducing the mare and the stallion. The place of performance for both parties and the place where any legal cases are to be heard is where the stud farm Gut Flehinghaus is based.
